Terms of Use

1. About This Site

Renaissance645.com ("the Site") is an independently operated community forum for verified residents and owners of the Renaissance building at 645 Front Street, San Diego, California. The Site is maintained by the Renaissance645 Committee ("we," "us," "our"), a group of volunteer homeowners. It is not operated by, affiliated with or endorsed by the Renaissance Owners Association Board of Directors, the property management company or any building vendor.

2. Acceptance of Terms

By creating an account or using this Site, you agree to be bound by these Terms of Use and our Community Guidelines. If you do not agree to these terms, do not register or use the Site. We may update these terms from time to time. Continued use of the Site after changes are posted constitutes acceptance of the updated terms.

3. Eligibility and Accounts

The Site is available only to residents, owners and authorized occupants of 645 Front Street. All registrations are reviewed and approved by the Committee before access is granted. You must provide accurate information during registration including your real name and unit number. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.

4. User-Generated Content

The Site allows registered members to post discussions, replies, event listings and other content ("User Content"). You retain ownership of your User Content. By posting it on the Site, you grant us a non-exclusive, royalty-free license to display, distribute and store that content in connection with operating the forum.

You are solely responsible for what you post. The views, opinions and statements expressed in User Content are those of the individual authors and do not represent the Committee, the Association or any other entity. We do not endorse, verify or guarantee the accuracy of any User Content.

All posts are subject to pre-publication review by the Committee. We reserve the right to reject, edit or remove any content that violates these Terms, the Community Guidelines or applicable law. This moderation is a good faith effort to maintain a constructive community environment. It does not make us the publisher or author of any User Content.

5. Prohibited Content

You may not post content that:

a. Is defamatory, meaning it presents false statements of fact that damage another person's reputation. Opinions and criticism are protected; false factual claims are not.

b. Violates another person's privacy by disclosing personal information such as home addresses, phone numbers, financial details, medical information or photos without consent.

c. Contains threats of violence, harassment, intimidation or any content that a reasonable person would consider abusive.

d. Discriminates against or demeans individuals based on race, color, religion, sex, national origin, disability, sexual orientation, gender identity, age or any other protected characteristic.

e. Is commercial in nature, including advertisements, solicitations, spam or affiliate marketing.

f. Infringes any copyright, trademark or other intellectual property right.

g. Impersonates another person or misrepresents your identity or affiliation.

h. Violates any applicable federal, state or local law.

6. Protected Speech and Advocacy

California law protects homeowner rights to communicate about common interest development issues. Under Civil Code section 4515, owners have the right to peacefully assemble and communicate with fellow owners about association matters including elections, legislation, candidates for the board and other matters of common concern. This Site is designed to facilitate exactly that kind of communication. Honest criticism of board decisions, questions about association finances, advocacy for governance changes and discussion of community issues are all welcome and encouraged.

7. Content Moderation

All new posts are held in a moderation queue for review before publication. The Committee reviews posts for compliance with these Terms and the Community Guidelines. Posts that are approved appear on the forum. Posts that are rejected will trigger an email to the author explaining the reason. The Committee may also use automated tools to assist in the review process. Final moderation decisions are made by human reviewers. We aim to review posts within 24 hours but do not guarantee any specific turnaround time.

8. Enforcement

Violations of these Terms may result in removal of the offending content, a warning, temporary suspension or permanent removal from the Site. The Committee applies enforcement consistently and in good faith. Repeated or severe violations will result in account deactivation. If your content is removed or your account is suspended and you believe the decision was in error, you may contact us through the Contact Us page to request a review.

9. Disclaimer of Liability

THE SITE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. We do not warrant that the Site will be available without interruption, that it will be free of errors or that any information on the Site is complete or accurate.

We are not responsible or liable for any User Content posted on the Site. Under Section 230 of the Communications Decency Act (47 U.S.C. section 230), providers of interactive computer services are generally not treated as the publisher of user-generated content. We are volunteers providing a communication tool for our community, not the authors of what our neighbors choose to post.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMMITTEE AND ITS INDIVIDUAL MEMBERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL OR SPECIAL DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR ANY USER CONTENT, REGARDLESS OF WHETHER SUCH DAMAGES ARE BASED ON CONTRACT, TORT, STRICT LIABILITY OR ANY OTHER THEORY.

10. No Professional Advice

All content on this Site is provided for informational and community discussion purposes only. Nothing on this Site constitutes legal, financial, accounting, tax, real estate or other professional advice. References to California law, the Davis-Stirling Act, CC&Rs, bylaws or other governing documents are for educational and informational purposes and should not be relied upon as legal guidance.

You should consult a qualified attorney, accountant or other licensed professional before taking any action based on information discussed on this Site. The Committee members are volunteer homeowners, not licensed professionals, and no contributor-reader relationship is created by your use of this Site.

11. Indemnification

You agree to indemnify and hold harmless the Committee and its individual members from any claims, damages, losses, costs or expenses (including reasonable attorney fees) arising from your use of the Site, your User Content or your violation of these Terms.

12. Privacy

We collect the minimum information necessary to operate the Site: your name, email address, unit number, phone number (if provided) and any content you post. We use this information solely to verify your residency, operate the forum and communicate with you about your account. We do not sell, share or disclose your personal information to third parties except as required by law. Your name is visible to other registered members if you choose to appear in the community directory. Unit numbers are collected for verification purposes only and are not displayed to other members.

13. Intellectual Property

The Site design, logo, name and original content created by the Committee are the property of the Renaissance645 Committee. User Content remains the property of the respective authors. You may not copy, reproduce or redistribute the Site or its contents for commercial purposes.

14. Governing Law

These Terms are governed by the laws of the State of California. Any disputes arising from these Terms or your use of the Site shall be resolved in the courts of San Diego County, California.
